Effective 11 September 2026
Agreement to these terms
These terms govern your use of the Nesaku website and any Nesaku service that refers to them. By using those services, you agree to these terms. If you use a service for an organisation, you confirm that you have authority to bind that organisation.
A proposal, statement of work, order form, or other signed client agreement may include different or additional terms. Where there is a conflict, the signed agreement takes precedence.
Our services
Nesaku provides technology advice, implementation, integrations, managed infrastructure, automation, and assistant services. The exact scope, service levels, fees, and responsibilities are defined in the applicable client agreement. Website content is general information and is not a binding service commitment.
Accounts and connected services
You are responsible for keeping your accounts and devices secure and for activity performed with your credentials. When you connect a third-party account, you authorise the service to access and act on the information covered by the permissions you approve. You can withdraw that access through the third party or by contacting us.
Acceptable use
You must not use the website or services to:
- break the law, infringe another person's rights, or facilitate fraud or abuse;
- access accounts, systems, or information without proper permission;
- introduce malicious code or interfere with the security or availability of a service;
- send unlawful spam or harmful, deceptive, or abusive content; or
- circumvent safeguards, usage limits, or provider terms.
AI-assisted work
Some services use AI models. AI output can be incomplete, inaccurate, or unsuitable for a particular purpose. You remain responsible for reviewing consequential communications, filings, transactions, and decisions before relying on or sending them. AI output is not legal, medical, financial, or other regulated professional advice.
Third-party services
Our services may connect to products provided by Google, OpenAI, hosting companies, communications providers, and other third parties. Their terms and availability also apply. We are not responsible for a third party changing, suspending, or discontinuing its service, but we will use reasonable care when selecting and operating integrations.
Fees
Fees, payment dates, taxes, renewals, and cancellation terms are set out in the applicable client agreement. Unless that agreement says otherwise, fees already earned for completed work or an active service period are not refundable.
Intellectual property
Nesaku and its licensors retain rights in the website, underlying tools, methods, and pre-existing materials. Ownership and permitted use of client-specific deliverables are governed by the applicable client agreement. You retain rights in the information and materials you provide to us.
Confidentiality and privacy
Each party must protect confidential information received from the other and use it only for the agreed work, subject to lawful disclosure requirements. Our handling of personal information is described in our privacy policy.
Availability and changes
We work to keep managed services reliable, but uninterrupted or error-free operation is not guaranteed. Maintenance, security incidents, provider outages, or circumstances outside our reasonable control may affect availability. We may change a service where reasonably necessary for security, compliance, or continued operation.
Disclaimers and liability
To the extent permitted by law, services are provided without implied warranties beyond those expressly stated in a signed agreement. Neither party is liable for indirect, incidental, special, or consequential loss arising from the services. Any additional exclusions, liability caps, or remedies are governed by the applicable client agreement and applicable law.
Suspension and termination
We may suspend access where reasonably necessary to address a security risk, unlawful use, non-payment, or a material breach. Either party may terminate according to the applicable client agreement. Provisions that by their nature should continue, including payment, confidentiality, intellectual property, and liability terms, survive termination.
Governing law
Unless a signed client agreement states otherwise, these terms are governed by the laws applicable in the United Arab Emirates. The courts identified by the applicable client agreement, or otherwise the competent courts of the United Arab Emirates, have jurisdiction.
